This is the second consecutive ruling in favor of PortsIB in relation to the appeals filed against this procedure

The High Court of Justice of the Balearic Islands (TSJIB) has dismissed the request for precautionary suspension filed against the contracting procedure for the buoy fields of Ports de les Illes IB (PortsIB), a public entity attached to the Ministry of the Sea and the Water Cycle.

The Court concludes that the necessary circumstances for granting a precautionary suspension are not present, considering that the appellant has not demonstrated irreparable harm resulting from the continuation of the proceedings. Furthermore, it notes that administrative actions enjoy a presumption of legality and points out that PortsIB's resolutions were previously upheld by the Central Administrative Court of Contractual Appeals (TACRC).

With this decision, PortsIB has now received two consecutive favorable rulings regarding appeals filed against this procedure. Last June, the TACRC (Administrative Court of Contractual Appeals) dismissed another appeal against the awarding of the Mallorca and Ibiza-Formentera concessions, ruling that the appellants lacked standing to challenge it.

The Ministry of the Sea and the Water Cycle points out that the successive appeals and challenges filed against this procedure have delayed the implementation of the new contract for the management of the buoy fields, and therefore its processing will continue to be promoted until the effective commissioning of the system.
