Concessions

Information on concessions affected by the 2018 effect

  • All port concessions in the maritime-terrestrial zone prior to the Coastal Law of 1988 end on July 29, 2018 in accordance with the provisions of the Sixteenth Transitional Provision of Royal Decree 876/2014, of October 10 (General Coastal Regulations) and the Seventh Transitional Provision of Law 10/2005, of June 21, on Ports of the Balearic Islands.
  • From this date, the concessionaires may be summoned to formalize the act of reversion of the concession (possessory recovery).
  • Until the reversion act is carried out, the concessionaire continues to hold the concession on a precarious basis under the same conditions derived from the concession title.
  • Those interested can request a new concession, in accordance with the requirements and documentation listed below.
  • New residential use concessions (housing) cannot be granted.
  • New concessions whose purpose is the provision of a service (economic activity) will be granted after a public tender.
  • An informational letter will be sent to the current concession holders regarding the termination of the concession on July 29, 2018.

Application for concessions without providing services to third parties

Requirements

  • Natural or legal person of Spanish nationality or of a member state of the EU
  • Non-EU foreigners. Compliance with the requirements of Article 153 of the General Coastal Regulations.
  • Not to be subject to any cause of prohibition to contract with the Public Administration as regulated in art. 71 of Law 9/2017, of November 8, on Public Sector Contracts.
  • The concession is intended for the applicant's own and private use (without providing services to third parties).

Documentation

  • Application for concessions without provision of services, link to the model: APPLICATION FOR ADMINISTRATIVE CONCESSION WITHOUT SERVICES.
  • Supporting documentation of the applicant's identity and the representation in which he acts, if applicable (ID, NIE, Deed of constitution and representation, if applicable).
  • Declaration of responsibility stating that you are not subject to any of the prohibitions for contracting with the Public Administration as regulated in Article 71 of Law 9/2017, of November 8, on Public Sector Contracts, link to the model: MODEL DECLARATION OF RESPONSIBILITY.
  • Declaration of responsibility for the administrative concession(s) in the public maritime-terrestrial domain of the Balearic Islands, of which the applicant is the holder or has requested its granting. Link to the model: RESPONSIBLE DECLARATION OTHER CONCESSIONS.
  • Proof of payment of the file formation fee (€96,61 to IBAN No. BANKIA ES98 2038 9501 6364 0000 2784) in the name of the applicant.
  • Proof of having established the provisional guarantee for the value of 2% of the installations and works to be carried out in the BANKIA account: ES98 2038 9501 6364 0000 2784 (Concept of the payment: GCO + Name and surname of applicant).
  • Basic project plan – in digital format – reviewed and signed by a qualified professional. For concessions adjacent to the seafront, the following are considered qualified professionals: Civil Engineer (Roads, Canals and Ports), Technical Engineer of Public Works (Technical Engineer of Public Works), and Civil Engineer. In the case of buildings in areas protected from the sea (i.e., not exposed to waves, currents, etc.), the following are also considered qualified: Architect, Technical Architect, and Building Engineer. The project plan will include the current condition and any maintenance and improvement measures. It is recommended to consult with the port's responsible technician.
